1. Acceptance of these Terms

By accessing or using the AimX website (the "Website") or by downloading, installing, or using the AimX software (the "Software", and together with the Website, the "Services"), you agree to these Terms. If you do not agree, you must not use the Services.

These Terms apply in addition to, and do not replace, any terms imposed by the platforms through which AimX is distributed — including the Steam Subscriber Agreement and any end-user licence agreement ("EULA") presented with the Software. Where the EULA and these Terms both apply, the EULA governs the Software and these Terms govern the Website. If there is a direct conflict, the EULA prevails in respect of the Software.

2. Who we are

3. Definitions

"AimX" means the crosshair overlay application and related branding, content, and materials published by Blackpoint Labs.
"Content" means all text, graphics, logos, images, software, and other materials made available through the Services.
"Steam" means the digital distribution platform operated by Valve Corporation ("Valve") through which AimX is sold and delivered.
"you" means the individual or entity accessing or using the Services.

4. Eligibility and age

You must be at least 13 years old to use the Services. If you are under 18 (or under the age of majority in the place where you live), you may only use the Services with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

By using the Services you represent that you meet these requirements and that you have the legal capacity to enter into this agreement. Purchasing through Steam is additionally subject to Valve's own eligibility and account requirements.

5. The AimX website

The Website provides product, support, privacy, and legal information about AimX. We may correct errors, update features, or change the availability of the Website or its content at any time without prior notice.

Information on the Website is provided for general information only and does not constitute an offer or a binding commitment. Steam is the authoritative source for price, purchase availability, system requirements at the point of sale, account licensing, and refunds.

6. Purchases, payment, and refunds

AimX is sold as a one-time purchase through Steam. All purchases, payments, billing, currency conversion, taxes, chargebacks, account licensing, and refunds are processed and handled by Valve and are subject to the Steam Subscriber Agreement, the Steam Refund Policy, and any other applicable Steam terms.

We do not collect or process your payment card details. Any pricing shown on the Website is indicative only; the price charged is the price shown on Steam at the time of purchase. If you are entitled to a refund, you must request it through Steam in accordance with Valve's policies.

Nothing in this section limits any statutory rights you may have as a consumer that cannot be excluded under applicable law.

7. Licence to use AimX

Subject to your compliance with these Terms, the applicable EULA, and the Steam Subscriber Agreement, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to download and use the Software for your own personal, non-commercial use on devices you own or control.

You must not, except to the extent permitted by law:

copy, reproduce, distribute, sell, rent, lease, lend, or sublicense the Software;
reverse engineer, decompile, or disassemble the Software, or attempt to derive its source code;
modify, adapt, translate, or create derivative works of the Software;
remove, obscure, or alter any proprietary notices, labels, or marks on the Software;
circumvent, disable, or interfere with any licensing, security, or ownership-verification features; or
use the Software to develop a competing product or service.

The Software is licensed, not sold, to you. All rights not expressly granted are reserved. A separate EULA may be presented to you when the Software is installed; where it is, that EULA sets out the full terms of your licence.

8. Acceptable use

When using the Services, you must not:

interfere with, disrupt, or compromise the operation, integrity, or security of the Services;
attempt to gain unauthorised access to any systems, accounts, or data;
use automated systems, scraping, or traffic that places an unreasonable burden on our infrastructure;
impersonate AimX, Blackpoint Labs, our staff, or any other person or entity, or misrepresent your affiliation with us;
use the Services or Content for any unlawful, fraudulent, deceptive, infringing, or harmful purpose; or
use the Software in any manner not permitted by these Terms, the EULA, or applicable law.

9. Game, anti-cheat, and tournament rules

AimX draws an independent overlay and does not read, inject into, or modify any game's memory or process. Even so, we make no guarantee that using a crosshair overlay is permitted in any particular game, on any platform, under any anti-cheat system, or in any league, ranked mode, or tournament.

You are solely responsible for reviewing and complying with the rules, terms, and policies that apply to the games and competitive environments you participate in. We are not responsible for any suspension, ban, penalty, or other consequence imposed on you by a game publisher, platform, anti-cheat provider, league, or event organiser arising from your use of AimX.

10. Intellectual property

The AimX name, logos, the Website, product artwork, the Software, and all related Content are owned by or licensed to Blackpoint Labs and are protected by intellectual property and other laws. Except for the limited licence in Section 7, nothing in these Terms transfers any intellectual property rights to you.

Third-party names, game titles, trademarks, and logos referenced or shown on the Website (including in screenshots) remain the property of their respective owners and are used for identification and illustrative purposes only. Their appearance does not imply any endorsement, sponsorship, or affiliation.

You may not copy, reproduce, republish, distribute, sell, or present AimX Content in a misleading way, except as permitted by law or with our prior written permission. If you believe Content on the Website infringes your rights, contact us at support@aimx-app.com.

11. Third-party services and links

The Services rely on and link to services operated by third parties, including Steam (Valve) and Discord. We do not control these services and are not responsible for their content, availability, security, terms, or privacy practices. Your use of any third-party service is governed by that third party's own terms and policies, and is at your own risk.

12. Updates and availability

We may release updates, patches, bug fixes, or new versions of the Software from time to time, and these may be required for continued use. We may also change, suspend, or discontinue all or part of the Services. We will use reasonable efforts to keep the Services available but do not guarantee uninterrupted or error-free operation, and we are not liable for any unavailability.

13. Disclaimers

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis, without warranties or conditions of any kind, whether express, implied, or statutory, including any implied warranties of satisfactory quality, merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that the Services will meet your requirements, be compatible with any particular game, hardware, or configuration, be uninterrupted, timely, secure, or error-free, or that any defects will be corrected. Nothing in these Terms excludes or limits any warranty or right that cannot lawfully be excluded or limited, including your statutory rights as a consumer.

14. Limitation of liability

Nothing in these Terms excludes or limits our liability for:

death or personal injury caused by our negligence;
fraud or fraudulent misrepresentation; or
any other liability that cannot be excluded or limited under applicable law.

Subject to the above, and to the fullest extent permitted by law, Blackpoint Labs will not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive loss or damage, or for any loss of profits, revenue, data, goodwill, or anticipated savings, arising out of or in connection with your use of or inability to use the Services, even if advised of the possibility of such loss.

Subject to the above, our total aggregate liability arising out of or in connection with the Services and these Terms will not exceed the greater of (a) the total amount you paid for AimX in the twelve (12) months before the event giving rise to the liability, or (b) [Liability Cap Amount].

15. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Blackpoint Labs and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of any third party.

16. Suspension and termination

We may suspend or terminate your access to the Website, and your licence to the Software may be revoked, if you materially or repeatedly breach these Terms or the EULA, or where required by law or by a platform such as Steam. You may stop using the Services at any time. Provisions that by their nature should survive termination — including those on intellectual property, disclaimers, limitation of liability, indemnity, and governing law — will continue to apply.

17. Changes to these Terms

We may revise these Terms when the Website, the Software, our business, or legal requirements change. The revised Terms take effect from the effective date shown at the top of this page. Where changes are material, we will take reasonable steps to bring them to your attention. Your continued use of the Services after the revised Terms take effect constitutes acceptance of them.

18. Governing law and jurisdiction

These Terms, their subject matter, and their formation are governed by the laws of England and Wales. You and Blackpoint Labs agree that the courts of England and Wales have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Services.

If you are a consumer, you may also be entitled to the protection of mandatory provisions of the law of the country in which you live, and nothing in these Terms affects your rights as a consumer to rely on those mandatory provisions.

19. General terms

Entire agreement

These Terms, together with the Privacy Policy, the EULA, and the Steam Subscriber Agreement, constitute the entire agreement between you and us regarding the Services and supersede any prior agreements on that subject.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No waiver

Our failure to enforce any right or provision of these Terms will not be a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, reorganisation, or sale of assets, or by operation of law.

Events beyond our control

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control.
